1. Agreement to Terms

Welcome to Food Tracker! These Terms of Service ("Terms") govern your access to and use of the Food Tracker application ("Application") provided by S-TECM ("we," "our," or "us"). By accessing or using the Application, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Application. Please read these Terms carefully before using the Application.

2. Description of Service

Food Tracker is a HIPAA-compliant web application that uses Google Gemini 1.5 Flash API for food item scanning, nutritional analysis, and carbohydrate tracking. The Application allows users to take photos of food items or nutrition labels, identify the food, determine carbohydrate content, and track meals through a calendar-based interface.

3. Account Registration and Security

To use certain features of the Application, you may need to create an account. You are responsible for:

• Providing accurate and complete information during registration.
• Maintaining the security and confidentiality of your account credentials.
• All activities that occur under your account.

We reserve the right to disable any user account if we believe you have violated these Terms.

4. User Conduct

When using the Application, you agree not to:

• Use the Application in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Application or its related systems.
• Interfere with or disrupt the operation of the Application.
• Upload or transmit any harmful code, malware, or other malicious content.

• Use the Application to store or transmit inappropriate or illegal content.
• Attempt to reverse engineer, decompile, or disassemble any part of the Application.

5. Medical Disclaimer

The Food Tracker Application is designed to assist with tracking carbohydrate intake and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before making any changes to your diet, insulin regimen, or other health practices.

The nutritional information provided by the Application is based on computer analysis and may not be completely accurate. While we strive for accuracy, we cannot guarantee the precision of carbohydrate counts or other nutritional data.

6. Intellectual Property Rights

The Application and its content, features, and functionality are owned by S-TECM and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Application, except as allowed by these Terms.

7. User Content

You retain all rights to any content you submit, post, or display on or through the Application ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving the Application.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate the rights of any third party.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Application, you consent to our collection and use of your information as described in the Privacy Policy.

9. Disclaimer of Warranties

We do not warrant that the Application will be uninterrupted or error-free, that defects will be corrected, or that the Application is free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL S-TECM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, AND EXEMPLARY DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless S-TECM, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Application.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Application. Your continued use of the Application after such modifications constitutes your acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the Application will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
